The Torres Jewel Co. Website has been made available to customers with the subsequent Terms and Conditions. These Terms and Conditions are subject to change at the discretion of Torres Jewel Co., therefore it is recommended that customers read all Terms and Conditions carefully before making any purchase.

 

These Terms and Conditions shall apply to all contracts entered into by Torres Jewel Co. (“Torres Jewel Co.”, “we”, “our”, or “us”). By placing your order with us you are accepting these Terms and Conditions. Where you do not accept these Terms and Conditions in full, you do not have permission to access the contents of this website and should cease using it immediately.

 

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms & Conditions”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

 

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms & Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

 

SITE ACCESS AND CHANGES

 

Our website changes regularly and access to this site is permitted on a temporary basis. We aim to update our site regularly and may change the content at any time, including the product details and pricing without notice. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material and/or fulfil an order based on an invalid price. You are also responsible for ensuring that all persons who access our site through your Internet connection are aware of these terms and that they comply with them.

 

CONTRACT

 

No contract will exist between you and Torres Jewel Co. for the sale of any product unless and until Torres Jewel Co. has accepted your order with a confirmation email and full payment is taken from your credit/ debit card, Bank Transfer or via Paypal. Our acceptance of your order brings into existence a legally binding contract between us. Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts.

 

Torres Jewel Co. reserves the right not to accept your order in the event that we are unable to obtain authorisation for payment, if shipping restrictions apply to a particular item, if the item ordered does not meet our quality control standards and is withdrawn, out of stock or if there is an error in pricing or content. We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable for any indirect or consequential loss, damage or expenses arising from not accepting your order and we shall have no liability to you, by way of compensation, other than to refund the amount paid for the goods in question.

 

PURCHASING POLICY

 

Our policy for all purchases made online by credit card is that we require 100 points ID in order to proceed to ship the goods out to you. We require a photocopy of both sides of the credit card used as well as an extra 100 points of ID, listed below are the options for ID.

DRIVERS LICENCE: 60

PASSPORT: 60

CREDIT CARD: 25

BANK CARD: 25

UTILITY BILLS: 25 (Must show name and address of customer)

MEDICARE CARD: 25

Any of these options you chose must have matching full names as the credit card used on this transaction.

 

PAYMENT

 

By purchasing on this site you confirm that the Paypal account, Bank Transfer Account or credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the Paypal account, Bank Account or credit/debit card to use it. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment we will not be liable for any delay or non-delivery. Payment can be made by Paypal or via your credit/debit card linked to your Paypal account. Also by any other methods that may be advertised on our website site.

 

All credit/debit card transactions on this site are processed using Pay Pal, which is a secure online payment gateway which encrypts your card details in a secure host environment.

 

The prices payable for ordered goods are as set out on our website in $AUD (Australian Dollars). All Taxes are listed at the time of purchase. Delivery charges will be clearly displayed when selected and included in the total cost plus taxes.

 

ORDER CANCELLATION

 

Unless you cancel your order within 7 working days after full payment has been made, acceptance of your order and completion of the contract between you and Torres Jewel Co. will be completed when the goods have been dispatched.

 

To cancel your contract you must notify us of your decision by email here using the subject heading ‘Cancellation’ and supplying your order number, details and address. Any returns or cancellations after the 7-day period stated above will be at the discretion of Torres Jewel Co.

 

DEFECTIVE AND DAMAGED ITEMS

 

All parcels must immediately be opened in the presence of the Courier upon receipt of the goods, to verify that the Goods contained in the parcel are untampered with and undamaged. You acknowledge that if you fail to do this and subsequently find the Goods are not contained therein, or have been damaged during delivery, we may not be able to claim against the Courier or against our insurers. Accordingly, if you do fail to do this, you agree that you will be solely liable for any such loss or damage and shall waive, release and indemnify us from and against any claims relating thereto, to the fullest extent permitted by applicable law.

 

If you should receive an item that is defective, damaged or not what you ordered, please contact us here within 5 working days. We will help you resolve any issues as quickly as possible by replacing the item, once the faulty item has been returned to us by post. We will confirm the return address in writing, once you have contacted us about the fault.

 

REFUNDS AND EXCHANGES

 

In the unlikely event that you are unhappy with your order please don’t hesitate to contact us.

 

Each piece of Torres Jewel Co. jewellery is made to order, therefore we cannot offer a refund on a piece unless it is found to be faulty. In certain circumstances, we may be able to offer an exchange for another piece.

 

Loose Diamond Items - All of our Diamonds are checked by Diamond Grading professionals and a registered Australian Valuer. If for some reason the diamond you receive is of a total different quality from what is stated on the GIA certificate, and you provide us with an independent Valuation performed by a Registered Valuer stating the different grade, we will refund you the amount you paid to us for that Diamond.

 

Jewellery Items - Most of our jewellery is handmade to order, therefore we only offer the return policy on earrings, necklaces, and bracelets.

 

In relation to rings they are made to your personal finger size, therefore we cannot refund them as it comes under a 'custom design'.

 

We will although, endeavour to make our customers happy and satisfied, and therefore consult any alternative options for you to be able to enjoy your special purchase.

 

If your item falls under the 'Jewellery' which includes only earrings, necklaces, and bracelets you are entitled to apply for a return code as long as:

·         There is no modification of any sort to the item

·         It is in its original condition

·         If there is no Custom Engraving on that item

·         It is not a Custom Design

 

You can apply for a return as a refund or exchange by contacting us at any time convenient to you, and we will guide you through the return process.

 

We provide you with a return code to make the process smoother for you and our team.

 

Returned goods will only be accepted with a return code.

 

Gemstone Return Policy - Customer satisfaction is our top priority. If you are not completely satisfied we are pleased to offer a seven (7) day return policy on all stocked gemstones. If within 7 days of receiving your gemstone(s) you become dissatisfied with it, return it in its original undamaged, unaltered condition for a refund or a credit. No questions asked, no hidden restocking fees, and no credit card charges. Refund will be processed onto the payment method used.

 

Please Call or Send us an Email asking for Return Instructions. The shipping & insurance fees are not refundable. All returned merchandise must be sent by registered insured mail. Appropriate return packaging and registered mail fees are the responsibility of the customer returning the merchandise. Insurance on return is the sender’s responsibility. After 7 days all sales are final (returned items must be postmarked within 7 days of the date you received the items).

 

Return Process - Once your returned item is received we will review the item to see that it complies with the Return Policy.

Once it is received and accepted, we will contact you to process your Refund or Exchange for a new jewellery item.

 

Returns without a Torres Jewel Co return code, and improperly or uninsured packages will be refused upon receipt.

 

If you decided that you do not want the merchandise after it has been shipped but before it arrives, Please Do Not Refuse Delivery. All Items must be returned to us only by registered mail, you must insure these items using the registered mail receipt number. If the merchandise is refused you will be liable for the full value of the item or items if lost and all brokerage charges and duties incurred upon its return.

 

The steps to take for a return are to firstly contact us.

 

To receive your Return Code. Your return code is a reference number that we use to process your return, it is issued once you have contacted our team and discussed the item/s you want to return. The return code must be placed on the box you are returning. We will issue you with the sticker for your return code to be placed on.

Once receiving your return code you must:

 

1.     Package your return as instructed by us. This packaging must include all the original packaging, any documents, such as paperwork provided by us, including your original receipts and boxes as well as any certificates originally supplied. Please Note: any certificate that is not returned will incur a replacement fee of $250.

 

2.     Fill out the appropriate information on your insured shipping bag as required by our return policy, which you will receive at the same time as you receive your return code. Please Note: you are responsible for your shipment until it is delivered to Torres Jewel Co. Pty Ltd.

Upon receipt of items, the Paypal account, Bank Account, credit or debit card originally used for the purchase will be credited with the cost of the goods minus the delivery charges (exceptions may apply). We will process your refund within 48 hours of receipt. Your credit card company or Bank may take 4-7 working days to credit your account.

 

PROMOTIONAL SAMPLES

 

Product samples lent to you by Torres Jewel Co. for promotional material, editorial use, photography or any other reason will be charged for in full if not returned in perfect condition. Unless otherwise agreed in writing by us, samples must be returned to us within 7 working days from the day of receipt.

 

LIMITATION OF LIABILITY

 

You agree that Torres Jewel Co. and its affiliates, partners, employees and licensors will not be held liable for any direct, indirect, incidental or consequential damages that may result from the use of this site or any related services.

 

INTELLECTUAL PROPERTY

 

The entire content of this website, including all jewellery designs, photographs, logo, copyright, trademarks and other intellectual property rights it contains, including the use of the name Torres Jewel Co. or Torres Jewel is the sole property of Torres Jewel Co. You may store, print and display the content supplied solely for your own personal use and you may draw the attention of others within your organisation to material posted on our site. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this website nor may you use any such content in connection with any business or commercial enterprise. By using this service, you agree that you will not attempt to undermine the integrity of this website.
